Terms of Service

1Acceptance of Terms

By downloading, installing, or using the Tembera mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users of the App, including visitors, registered users, and others who access the service.

2Description of Service

Tembera is a travel discovery and social platform that allows users to explore places in Burundi, share moments through photos and videos, interact with a community of explorers, and discover nearby attractions. We reserve the right to modify, suspend, or discontinue the service at any time without notice.

3User Accounts

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.
• Not create more than one account per person.

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this age requirement.

4User-Generated Content

The App allows you to post photos, videos, captions, comments, and ratings ("Content"). By posting Content, you grant Tembera a non-exclusive, worldwide, royalty-free license to use, display, and distribute your Content within the App.

You agree NOT to post Content that:

• Is unlawful, harmful, threatening, abusive, or defamatory.
• Infringes any intellectual property or privacy rights of others.
• Contains nudity, explicit material, or graphic violence.
• Constitutes spam, advertising, or unauthorized solicitation.
• Impersonates any person or entity.
• Contains malware, viruses, or harmful code.

We reserve the right to remove any Content and suspend or terminate accounts that violate these guidelines.

5Intellectual Property

The App and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Tembera and its licensors. The Tembera name, logo, and all related marks are trademarks of Tembera. You may not use our trademarks without our prior written permission.

6Location Services

The App uses your device location to provide nearby place discovery and map features. Location data is used only to provide these in-app services and is not sold to third parties. You can revoke location permission at any time in your device settings, though this will limit certain features of the App.

7Prohibited Uses

You agree not to use the App to:

• Scrape, crawl, or harvest any content or data from the App.
• Attempt to gain unauthorized access to any part of the App or its related systems.
• Use the App for any unlawful purpose or in violation of any regulations.
• Interfere with or disrupt the integrity or performance of the App.
• Reverse engineer, decompile, or disassemble any portion of the App.

8Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Place information, ratings, and descriptions within the App are provided for informational purposes only and may not always be accurate or up to date.

9Limitation of Liability

To the maximum extent permitted by applicable law, Tembera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising out of or in connection with your use of the App.

10Account Termination

You may delete your account at any time from within the App under Profile → Settings → Delete Account, or by visiting our account deletion page. We reserve the right to suspend or terminate your account at our discretion if you violate these Terms.

11Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

12Governing Law

These Terms shall be governed by and construed in accordance with the laws of Burundi, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bujumbura, Burundi.
